dc.description.abstractСтаття присвячена проблемам правового забезпечення інвестування в умовах воєнного стану та повоєнної відбудови України та ролі в цьому цифровізації. З метою виявлення ефективних правових механізмів інвестування та потенціалу цифровізації в досягненні максимальних результатів залучення та реалізації інвестицій, поступу цифровізації та її соціальному забезпеченню аналізуються нормативно-правові акти України та ЄС щодо зазначених відносин, праці дослідників, новітні проекти, спрямовані на вирішення завдань інвестування повоєнної відбудови та залучення до цього надбань цифровізації. Виявляються надбання останніх років (прийняття низки нових законів, залучення України до важливих проектів за участі ЄС, Великої Британії/Об’єднаного Королівства, що мають сприяти вирішенню Україною важливих для неї проблем повоєнної відбудови, вдосконалення використання цифрових технологій в ключових сферах суспільного буття) та обставини, що стримують успішний розвиток зазначених відносин (прогалини в чинному законодавстві України щодо державно-приватного партнерства/ДПП, неврахування досвіду ЄС щодо інституційного ДПП за участі кількох дружніх держав, зволікання з систематизацією законодавства про цифровізацію). Пропонуються заходи, спрямовані на вирішення виявлених проблем в правовому регулюванні відносин інвестування та цифровізації.
dc.description.abstractThe article is devoted to the problems of legal support for investment in the conditions of martial law and post-war reconstruction of Ukraine and the role of digitalization in this. In order to identify the effective legal mechanisms of investment and the potential of digitalization in achieving the maximum results of investment attraction and realization, the progress of digitalization and its social security, the normative and legal acts of Ukraine and the EU regarding the specified relations, the works of researchers, and the latest projects aimed at solving the investment tasks of post-war reconstruction are analyzed and the involvement of digitization assets in this. The acquisitions of recent years are revealed (the adoption of a number of new laws, the involvement of Ukraine in important projects with the participation of the EU, Great Britain/United Kingdom, which should help Ukraine solve the problems of post-war reconstruction that are important for it, improving the use of digital technologies in key areas of social life) and circumstances hindering the successful development of these relations (gaps in the current legislation of Ukraine regarding public-private partnership/ PPP, failure to take into account the EU experience regarding institutional PPP with the participation of several friendly states, delay in the systematization of digitalization legislation). Measures aimed at solving identified problems in the legal regulation of investment relations and digitalization are proposed.
