| dc.description.abstract | Наукові дослідження у сфері «цифрових» технологій містять великий потенціал розвитку внаслідок того, що вони стають витоком прикладних досягнень на десятки років. Стаття присвячена аналізу перспективи зміни правових умов для створення та адміністрування електронних публічних реєстрів в Україні. Досліджено стан законодавства про публічні реєстри й обґрунтовано проблеми, що потребують законодавчого врегулювання. Надано науково-практичний коментар законопроекту про публічні електронні реєстри. Виокремлено законоположення щодо створення та адміністрування електронних публічних реєстрів як основоположних напрямків реформування законодавства у сучасних умовах. Проаналізовано основоположні принципи і мету створення та адміністрування інформаційних ресурсів у сфері реєстрів. Надано характеристику відносинам, які виникають у сфері створення та адміністрування електронних публічних реєстрів. Розкрито причини критичного ставлення практикуючих юристів до утворення Реєстру реєстрів. Наголошено, що правова організація системи електронних публічних реєстрів потребує узагальнення пропозицій науковців стосовно моніторингу корупційних проявів при створенні та адмініструванні електронних публічних реєстрів. Превентивним підходом тут слід вважати узгодження національного і міжнародного законодавства в частині втілення застережень від загроз публічним та приватним інтересам в системі публічних реєстрів. | |
| dc.description.abstract | Scientific research in the field of «digital» technologies has a great potential for development due to the fact that they become the source of applied achievements in decades. The article is devoted to the analysis of the prospect of changing legal conditions for the creation and administration of electronic public registers in Ukraine. The state of the legislation on public registers is investigated and the problems that require legislative regulation are substantiated. A scientific and practical commentary on the bill on public electronic registers is provided. The legislation on creation and administration of electronic public registers as the basic directions of reforming the legislation in the current conditions is distinguished. The basic principles and purpose of creating and administering information resources in the registry are analyzed. It describes the relations that arise in the sphere of creation and administration of electronic public registers. The reasons for the critical attitude of practicing lawyers to the creation of the Register of Registers are revealed. It is emphasized that the legal organization of the system of electronic public registers requires generalization of proposals of scientists regarding the monitoring of corruption manifestations in the creation and administration of electronic public registers. The harmonization of national and international legislation regarding the implementation of warnings against threats to public and private interests in the system of public registers should be considered as a preventive approach. There is a change in the legal organization of the system of electronic public registers in Ukraine. This manifestation of digitization of the economy is conditioned by the new course of its deregulation. When updating the legislation on the system of public registers in Ukraine, the authorizations of the registry creator, registry holder, technical administrator and other relevant bodies and organizations to form and transmit registry information are specified and specified. | |
